Why We Are Not a Registered Independent School
Under UK law (Section 463 of the Education Act 1996), a setting must register as an independent school if it provides full-time education to five or more pupils of compulsory school age, or one or more pupils with an Education, Health and Care Plan (EHCP) or “Looked After” status.
The Rainbow Nest is a part-time provision and does not meet the criteria for a registered school for the following reasons:
Part-Time Hours: We operate for a maximum of 15 hours per week (Monday to Thursday, 9:30 am – 2:30 pm). This falls below the threshold generally considered “full-time” by the Department for Education.
Supplementary Education: Our service is designed to complement, not replace, a child’s main education. We do not provide “all or substantially all” of a child’s education.
Dual Registration: All learners at The Rainbow Nest must remain on the roll of a registered school or be part of a formal package overseen by the Local Authority where the pupil receives other education other than that provided by The Rainbow Nest. We work as a partner to the “home school” to provide specific sensory and social-communication support.
Our Commitment to Quality & Oversight
While we are a “non-school” provision, we pride ourselves on maintaining the high standards expected of the education sector. We align our practice with the DfE’s Voluntary National Standards for Non-School Alternative Provision (2025).
Qualified Leadership: Our provision is led by a teacher with Qualified Teacher Status (QTS) and over 13 years of classroom experience.
Safeguarding: We follow Keeping Children Safe in Education (KCSIE) statutory guidance. All staff undergo Enhanced DBS checks, and we have a designated Lead Safeguarding Person (DSL) on-site at all times.
Collaborative Reporting: We do not operate in isolation. We provide regular progress reports, attendance data, and sensory assessments to the commissioning school or Local Authority to ensure the child’s EHCP outcomes are being met through our online platform Tapestry.
Small Group Focus: To maintain safety and quality, we limit our capacity to a maximum of 10 learners per session.

The Rainbow Nest is an ideal choice for schools looking for “Off-site Direction” or Local Authorities arranging “Section 19” provision for children with medical or sensory needs.
Funding: Placements are typically funded via the child’s school SEN budget or the Local Authority’s EHCP high-needs funding.
Insurance: We hold comprehensive Public Liability and Professional Indemnity insurance specifically for education and outdoor learning.
Site Safety: Our site undergoes regular health and safety audits and fire risk assessments.
